Terms and Conditions

These Terms and Conditions (“Terms”) together with our Privacy Policy govern the provision of tutoring and educational services (“Services”) by Cognition Crafters (“we”, “us, “our”) to you, the client (“you”, “your”). By accessing our website or engaging our services, you agree to be bound by these Terms.

1. SERVICES PROVIDED

1.1. Cognition Crafters provides tutoring and educational support Services for primary, secondary, and tertiary students. Services may be delivered face-to-face or online.

1.2. Specific details, schedules, and fees are agreed upon at the time of booking.

1.3. We reserve the right to modify, suspend, or discontinue any part of our Services at any time.

1.4. We aim to carefully match students with suitable tutors; however, we do not guarantee a particular tutor’s ongoing availability. We reserve the right to substitute tutors where necessary.


 

2. ELIGIBILITY

Our services are available to students of all ages.

2.1. Where a student is over the age of 18 years of age, they provide consent and are responsible for all bookings, payments and communications.

2.2. Where the student is under 18 years of age, a parent or legal guardian must provide consent and is responsible for all bookings, payments, and communications.


 

3. BOOKINGS AND PAYMENTS

3.1. Tutoring sessions are scheduled through direct communication between you (the client), and Cognition Crafters, or your assigned tutor.

3.2. Invoices are issued within five (5) business days following the completion of each tutoring session.

 

3.3. Payment of each invoice is required within seven (7) days from the invoice date, unless an alternative arrangement has been agreed to in writing.
 

3.4. You are required to ensure a valid payment method to facilitate timely payments.

3.5. By making payment to Cognition Crafters for services rendered, you consent to Cognition Crafters securely storing your payment details for the purpose of processing future payments.

 

3.6. By providing your payment details, you authorise Cognition Crafters to automatically debit your nominated payment method for any outstanding amounts if an invoice remains unpaid seven (7) days after its due date.
 

3.7. Failure to pay outstanding fees may result in the suspension or termination of tutoring services until full payment is received.

 

4. CANCELLATIONS AND REFUNDS

4.1. A minimum of 24 hours’ notice is required to cancel or reschedule a session.
 

4.2. Cancellations made with less than 24 hours’ notice may incur the full fee.
 

4.3. Refunds will only be provided in accordance with Australian Consumer Law.
 

4.4. In the event of tutor unavailability, we will offer to reschedule or allocate another tutor. If no immediate alternative is available, we will place you on a priority waiting list and inform you as soon as a tutor becomes available.


5. LATE ARRIVALS AND NO SHOWS
 

5.1. Tutors will wait up to 20 minutes for a late student. After this time, the session may be forfeited without refund.

5.2. If a student fails to attend a timetabled session without notice, the full fee will apply.

6. ONLINE TUTORING

6.1. For online sessions, students are responsible for access to a suitable device and required software, and access to a stable internet connection.


6.2. We are not responsible for disruptions caused by technical issues out of our control.



7. STUDENT CONDUCT

7.1. Students are expected to attend sessions punctually, engage respectfully with tutors and staff and complete assigned tasks where appropriate.

 

7.2. We reserve the right to suspend or terminate Services if a student participates in any inappropriate behaviour.
 

7.3. Students are expected to engage in an active participation in the learning process, and the work submitted must be their own.

8. TUTORS AND CONTRACTORS
 

8.1. Tutors engaged by Cognition Crafters are employed or contracted based on their subject expertise, qualifications, safety checks, reference checks and demonstrated teaching availability.
 

8.2. While we are committed to delivering high- quality tutoring Services, we do not guarantee any specific academic outcomes, grades, or results.
 

8.3. We are dedicated to support and guide students in their learning; however, we do not complete assignments or academic tasks on behalf of students.

9. INTELLECTUAL PROPERTY
 

9.1. All materials provided by Cognition Crafters, including worksheets, lesson plans, assessments, and digital content, are our intellectual property unless otherwise stated.


9.2. These materials are for personal educational use only and may not be reproduced, shared, or sold without written permission.

10. PRIVACY

10.1. We are committed to protecting your privacy. Personal information is collected and handled in accordance with our Privacy Policy.

11. LIMITATION OF LIABILITY

11.1. To the fullest extent permitted by law, Cognition Crafters is not liable for any loss, damage, or expense arising from the use of our Services or website.

12. HEALTH, SAFETY AND DUTY OF CARE
 

For face-to-face tutoring sessions, we take reasonable steps to provide a safe, respectful, and supportive learning environment. Our duty of care is exercised in accordance with applicable laws and professional standards.

12.1. Child Protection and Mandatory Reporting
Cognition Crafters complies with all applicable child protection legislation in the jurisdictions in which it operates, including but not limited to the Children and Young Persons (Care and Protection) Act 1998 (NSW).

12.2. To ensure student wellbeing and safety, tutors are expected to act professionally, respectfully, and in the best interests of the student at all times. All tutors working with children hold a valid Working With Children Check (WWCC) or equivalent clearance, where required by law. Appropriate boundaries are maintained in all tutoring interactions, whether conducted face-to-face or online.


12.3. Parents, guardians, or students must disclose any relevant medical conditions, allergies, or safety concerns that may affect tutoring sessions. Failure to disclose relevant information may limit our ability to provide appropriate support and ensure student safety.


12.4. Parents or guardians are responsible for ensuring the safe arrival and departure of students to and from face-to-face tutoring sessions unless otherwise agreed in writing.


12.5. For in-home or third-party locations, responsibility for the safety and suitability of the premises rests with the parent, guardian, or student.

13. TERMINATION OF SERVICES
 

13.1. We reserve the right to terminate Services with reasonable notice where these Terms are breached or where continuation is not in the best interests of the student or tutor.

14. CHANGES TO THESE TERMS

 

14.1. We reserve the rights to update or amend these Terms at any time by publishing an updated version on our website.

 

14.2. Continued use of our Services constitutes acceptance of any revised Terms.

15. GOVERNING LAW

15.1. These Terms are governed by the laws of New South Wales, Australia and any disputes are subject to the jurisdiction of the courts of that state.
